2. General Provisions

These General Terms and Conditions (hereinafter: "GTC") regulate the conditions for using the electronic commercial services operated by Arvoa Lux Kft. (hereinafter: "Service Provider") on the website https://peakgear.hu (hereinafter: "Webshop").

By purchasing in the Webshop, the Buyer expressly accepts the provisions of these GTC and acknowledges them as binding. The Service Provider reserves the right to unilaterally modify the GTC; the modified GTC shall enter into force upon publication in the Webshop and shall apply to contracts concluded after its entry into force.

The language of the contract is Hungarian. The concluded contract is not considered a written contract, the Service Provider does not file it, so it is not accessible or viewable afterwards. The contract is concluded electronically, by conduct.

3. Applicable Laws

These GTC and the legal relationship between the parties are governed by the provisions of Hungarian law, with particular regard to the following legal acts:

  • Act V of 2013 on the Civil Code (Ptk.)
  • Act CVIII of 2001 on certain issues of electronic commerce services (Ekertv.)
  • Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses
  • NGM Decree 19/2014. (IV. 29.) on the procedural rules for handling warranty and guarantee claims for goods sold under a contract between a consumer and a business
  • Government Decree 151/2003. (IX. 22.) on the mandatory warranty for certain durable consumer goods
  • Act CLV of 1997 on consumer protection (Fgytv.)
  • Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR)

4. Order Process and Contract Formation

The Buyer can make purchases in the Webshop with or without registration. To place an order, the Buyer must provide their shipping and billing information next to the products placed in the cart, and select the payment and shipping method.

By clicking the "Order" button, the Buyer makes an offer with a payment obligation. The Service Provider confirms the receipt of the order with an automatic confirmation email; this confirmation only certifies the arrival of the order in the system and does not constitute acceptance of the offer.

The sales contract is concluded upon the Service Provider's confirmation/acceptance of the order. If the automatic email confirming the receipt of the order does not reach the Buyer within 48 hours, the Buyer is released from the offer's binding nature.

In case of incorrect pricing, stock shortage, or other obstacles detected during order processing, the Service Provider shall immediately notify the Buyer and may withdraw from the contract.

5. Prices, Payment Terms

The prices indicated in the Webshop are in Hungarian Forints (HUF) and include the current statutory VAT. The prices are valid at the time of placing the order and do not include shipping costs.

Available payment methods:

  • Credit card payment at the time of placing the order (via the payment interface provided by Shopify Payments)
  • Bank transfer in advance to the Service Provider's Erste Bank account 11600006-00000002-01784989
  • Cash on delivery upon receipt (for an additional cash on delivery fee)

The invoice is issued by the Service Provider through the electronic invoicing system operated by Billingo Technologies Zrt. and sent to the email address provided by the Buyer.

6. Delivery

The detailed conditions of delivery, shipping fees, and expected delivery time are contained in the Shipping and Payment Conditions menu item.

7. Right of Withdrawal

Consumers, as defined by Government Decree 45/2014. (II. 26.), are entitled to a 14-day right of withdrawal without stating a reason. The conditions for exercising the right of withdrawal, the sample withdrawal form, and the exceptions are detailed in the Right of Withdrawal Information and Return Conditions menu item.

8. Warranty, Guarantee

8.1. Implied Warranty

In case of faulty performance by the Service Provider, the Buyer may enforce an implied warranty claim against the Service Provider according to the rules of the Civil Code. The Buyer may, at their option, request repair or replacement, unless fulfilling the chosen claim is impossible or would incur disproportionately higher costs for the Service Provider compared to fulfilling another claim. If the Buyer has not requested or could not request repair or replacement, they may request a proportionate reduction of the consideration, or – as a last resort – may withdraw from the contract.

The Buyer must notify the defect immediately after its discovery, but no later than within 2 months. After the 2-year limitation period from the performance of the contract, the Buyer cannot enforce their implied warranty rights.

8.2. Product Warranty

In case of a defect in a movable item (product), a Buyer who qualifies as a consumer may, at their option, enforce an implied warranty or product warranty claim. Within the framework of a product warranty claim, the Buyer may only request the repair or replacement of the defective product directly from the manufacturer. A product is considered defective if it does not meet the quality requirements in force at the time of its placing on the market, or if it does not have the properties stated in the description provided by the manufacturer.

You can enforce your product warranty claim within 2 years from the date the product was placed on the market by the manufacturer. After this deadline, you lose this entitlement.

8.3. Guarantee

Based on Government Decree 151/2003. (IX. 22.), the Service Provider is obliged to provide a mandatory guarantee for certain durable consumer goods. The duration of the guarantee is:

  • Between HUF 10,000 and HUF 100,000 selling price: 1 year
  • Between HUF 100,000 and HUF 250,000 selling price: 2 years
  • Above HUF 250,000 selling price: 3 years

The guarantee period begins on the day the consumer good is handed over to the Buyer. The costs incurred for fulfilling the guarantee obligation are borne by the Service Provider.
